Terms of Use

Please read these terms carefully before using FaxDoc.

These Terms of Use ("Terms") govern your access to and use of the FaxDoc mobile application ("App") and the website at faxdoc.xyz ("Site"). By downloading, installing, or using the App, or by accessing the Site, you agree to be bound by these Terms. If you do not agree, do not use the App or Site.

1. Eligibility

You must be at least 13 years of age to use FaxDoc. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes, in accordance with these Terms and Apple's App Store terms.

3. Prohibited Uses

You agree not to use FaxDoc to:

  • Send unsolicited bulk faxes (spam) or any content prohibited by applicable law
  • Transmit harassing, defamatory, obscene, fraudulent, or illegal content
  • Violate any individual's or entity's privacy or intellectual property rights
  • Circumvent, disable, or interfere with security-related features of the App
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the App
  • Use the App for any commercial mass-faxing service or resale without our written consent
  • Impersonate any person or entity, or falsely state your affiliation with any person or entity
  • Violate any applicable local, national, or international law or regulation

4. Subscriptions and Credits

FaxDoc is free to download. Access to fax sending requires a subscription or the purchase of credits.

  • Subscription: Subscriptions are billed on a recurring basis (weekly, monthly, or annually) through your Apple ID account. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Credits: Credits may be purchased as a one-time payment and used to send individual faxes.
  • Billing: Payment is charged to your Apple ID at confirmation of purchase.
  • Cancellation: You may manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
  • Refunds: All purchases are subject to Apple's refund policy. We do not process refunds directly. Please contact Apple Support for refund requests.
  • Price changes: We reserve the right to modify pricing. We will provide reasonable advance notice of any price changes.

5. User Content and Documents

You retain ownership of all documents and content you upload to FaxDoc. By uploading a document for transmission, you grant us a limited, temporary license to process and transmit that document solely for the purpose of completing your fax request. We do not claim any ownership over your documents.

You represent and warrant that you have the necessary rights, permissions, and authorizations to send any documents you transmit via FaxDoc, and that doing so does not violate any third-party rights or applicable law.

6. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. Fax delivery depends on factors including recipient fax line availability, network conditions, and third-party infrastructure. We are not responsible for failed transmissions caused by factors beyond our control.

We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice.

7. Intellectual Property

The App, Site, and all content, features, and functionality (including but not limited to the FaxDoc name, logo, design, text, graphics, and software) are owned by or licensed to us and are protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works based on any part of FaxDoc without our prior written consent.

8. Privacy

Your use of FaxDoc is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE APP AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless FaxDoc and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the App in violation of these Terms; (b) your violation of any applicable law; or (c) your infringement of any third-party rights.

12. Third-Party Services

The App may integrate with or link to third-party services (e.g., Apple's in-app purchase system). Your use of such third-party services is governed by their respective terms and policies. We are not responsible for the content, availability, or practices of third-party services.

13. Apple-Specific Terms

The following terms apply to your use of the App downloaded from the Apple App Store:

  • These Terms are between you and us, not between you and Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund you the purchase price (if any). Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims you or any third party may have relating to the App.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction, to the extent permitted by law.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top. Continued use of the App after changes constitutes acceptance of the updated Terms. If you disagree with any changes, you should stop using the App and cancel any active subscriptions.
